Overview Description

Records―except basic identifying information―relating to a conviction for misdemeanor marijuana possession committed before Dec. 10, 2012 which would not have been a criminal offense if committed on or after that date can be sealed by the court 30 days after the petition is filed. There is no statutory language regarding ineligible offenses.

Procedure General

Petition must be filed in the district court in the district in which any conviction records are located. For specific procedure, see C.R.S. §§ 24-72-710, 24-72-703(5). Following an order to seal the records pursuant to this section, petitioner may request and the court may grant an order sealing the civil case. C.R.S. § 24-72-710(3).


Petitioner must pay the filing fee required by law plus $65. C.R.S. § 24-72-710(2)(II).


There is no statutory language regarding the effect of sealing under this section.



Waiting Periods

The petition may be filed at any time. The petition must be posted on the website of the state court administrator for 30 days before the record can be sealed.
