An adjudication that resulted from being a victim of human trafficking can be vacated by the court immediately. Ind. Code Ann. § 31-37-22-11.
Vacatur is not permitted if the delinquent act resulted in bodily injury to another person. Ind. Code Ann. § 31-37-22-11(b)(2).
The motion must be filed with the court that adjudicated the trafficked child. For the specific procedure, see Ind. Code Ann. § 31-37-22-11.
There is no statutory language regarding fees.
The adjudication is vacated.
The petition can be filed at any time.
