Overview Description

Records relating to Class E offenses committed between the ages of 18-20 can be restricted by the court four years after sentence completion. 15 M.R.S. § 2252.

Class E crimes under Title 17-A, chapter 11. 15 M.R.S. § 2251(6).

Procedure General

The petition must be filed in the same court as the underlying proceeding. 15 M.R.S. § 2253. For the specific procedure, see 15 M.R.S. § 2251 et seq.

Fees

There is no statutory language regarding fees.

Effect

The arrest and court records are confidential and cannot be disseminated, except to a criminal justice agency. 15 M.R.S. § 2255. The person can chose not to disclose the record when asked by any party other than a criminal justice agency. 15 M.R.S. § 2256.

If a person is convicted of a subsequent offense, the confidential record becomes public. 15 M.R.S. § 2254(7).
