Overview Description

Records of a conviction that resulted from being a victim of human trafficking can be expunged by the court. Ohio Rev. Code Ann. § 2953.38.

Ineligible Category or Citation

Murder and rape are ineligible. ORC Ann. § 2953.38(B).

Procedure General

The petition must be filed in the sentencing court. For the specific procedure, see Ohio Rev. Code Ann. § 2953.38.

Fees

The petitioner must pay $50, unless indigent. Ohio Rev. Code Ann.§ 2953.32(C)(3).

Effect

The record is destroyed so that it is permanently irretrievable. The applicant can, and the court will, reply that no record exists with respect to the applicant upon any inquiry into the matter. Ohio Rev. Code Ann. §§ 2953.38, 2953.32 et seq.
